A personal injury claim is a physical or mental injury that is the result of someone's negligence. To have a claim, you must be able to show that you were injured by someone's negligence and that you have damages. Damages may include loss of enjoyment, loss of love and affection, property damage, out-of-pocket expenses, lost wages, and disfigurement.
PIP is Personal Injury Protection. PIP assists automobile injury clients in paying their medical expenses regardless of who was at fault in the accident. It is a component of your New Jersey auto insurance policy and is often the first source of coverage for medical bills after a car accident.
In most cases, an injured person can still recover even if they are partly to blame for the injury. New Jersey follows a "modified comparative negligence" rule — you can recover as long as you are not more than 50% at fault, though your recovery will be reduced by your percentage of fault.
